The Will of

Catherine (SUTTON) DUNNUCK

 Written: :October 1834 - Presented April 23, 1836

In the name of God, Amen! I Catherine Dunnuck of the County of Baltimore and state of Maryland being of sound and disposing mind memory and understanding do make and publish this my last will and testament in manners and form following that is to say, I have prior to this writing leased or rented as may be my Farm called Suttons Delight unto my grandson Henry D. Almony for the term of eight years commencing the first day of April in the year of our lord Eighteen hundred and thirty four for a certain annual share of produce as specified by writing agreed upon between us, therefore I give and bequeath unto my said grandson Henry D. Almony the services of my negro slave Alexander to serve him for that term of eight years and after the first day of April in the year of our Lord eighteen hundred and forty two when the lease or rent as may be expires as agreed between my Grandson Henry D. Almony and myself I will and desire as soon as it can conveniently be done that my executor herein after named do sell and dispose of at public sale the above mentioned Farm called Sutton's Delight and my negro slave Alexander to the highest bidder. And I do hereby authorize and empower my Executor hereinafter named at his receiving the full amount of money arising from the sale of my said Farm and said negro slave, to execute in due form to the several and respective persons who may become the purchaser or purchasers a good and sufficient deed for said farm and a good and sufficient bill of sale or any other legal writing for said negro slave, provided that if my Grandson Henry D. Almony be disposed at that time and place to purchase the said Alexander for the sum of Two hundred and fifty dollars he is to become my said grandson's property. The terms of sale to be one third of the money on the day of sale, one third in six months and the remaining third in twelve months. And I give and determine that the receipts of the respective heirs for their respective portions hereinafter devised unto them will entitle by law to my grandson Henry D. Almony (should he become the purchaser of said Alexander for the said sum of two hundred and fifty dollars) a good and sufficient right to the aforesaid negro Alexander. I further will and bequeath that the money arising from the sale of the said Farm and said negro slave be disposed of by my Executor hereinafter named in the following proportions. I give and bequeath unto the heirs of my

daughter Sarah Wiley wife of Andrew Wiley deceased the sum of one hundred dollars. I give and bequeath unto my

son Joshua Dunnuck the sum of one hundred dollars. I give and bequeath unto my

daughter Darcus Almony wife of William Almony the sum of one hundred dollars. I give and bequeath unto my

daughter Elizabeth Slade wife of Josias Slade deceased the sum of one hundred dollars. I give and bequeath unto my

daughter Kiturah Koffelt wife of George Koffelt deceased the sum of one hundred dollars. I give and bequeath unto my

daughter Rachiel Ayres wife of John Ayres, the sum of one hundred dollars for the use of her children. I give and bequeath unto my

son Joseph Dunnuck the sum of one hundred dollars and the
remaining term of years negro Lewis may have to serve
. I will and bequeath the residue and remainder of said sale be equally divided among all my children they or their heirs as may be than. And I do further determine that if any or each of the heirs of John Dunnuck deceased my children sue Joseph Dunnuck my son who was appointed Executor of John Dunnuck deceased will and testament for the performance of that thrust (which I believe he has faithfully executed that they or each of them so doing shall forfet the sum or sums respectively heretofore left to them by me. And Lastly I hereby nominate constitute and appoint my grandson Henry D. Almony to be executor of this my last will and testament. In Testimony whereof I have hereunto subscribed my mark for my name and affixed by seal this thirteenth day of October in the year of our Lord eighteen hundred and thirty four.r for the

Signed sealed published and declared by Catherine Dunnuck the above named Testatrix, as and for her last will and testament in the presence of us who at her request, in her presence, and in the presence of each other have subscribed our names as witnesses thereto. The words "my son" being first interlined.

Baltimore County : On the 23 of April 1836 came Benjamin Sutton and Joshua M. Bell two of the subscribing witnesses to the aforegoing last Will and testament of Catherine Dunnuck late of said County deceased and made Oath in the Holy Evangely of Almighty God that they did see the Testatrix sign and seal this will that they heard her publish pronounce and declare the same to be her last will and testament that at the time of her so doing she was to the best of their apprehensions of sound and disposing mind memory and understanding and that they together with Robert Stirling the other subscribing witness thereto subscribed their name as witnesses to this will in her presence at her request and in the presence of each other: ---- Sworn to in open Court.

Not mentioned it Catherine's will are three living children who were listed in Catherine's husband John's will. John's will Ruth, John, Thomas
